These Terms of Use ("Terms") govern your access to and use of thesomascript.com, including its public pages, the browser-based Breath tool, the Field Guide companion app and its offline functions, free excerpts or downloads, and any other page, tool, or web application controlled by The Soma Script LLC that links to these Terms (collectively, the "Site"). The Site is owned and operated by The Soma Script LLC ("The Soma Script," "we," "us," or "our").
Outside checkout, payment, retailer, application, hosting, and digital-delivery services operate under their own terms. Those services are addressed below.
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site. When you purchase a product, product-specific terms displayed at checkout and the terms of the outside provider handling the transaction or delivery also apply.

1. The Site and Its Content
The Site provides information about Max Theodor, Edge to Path, related publishing work, excerpts, educational materials, the Breath tool, the Field Guide companion app, reader-safety resources, and links to outside purchase and delivery services.
The Site and its content are offered for education, reflection, commentary, and general information. The Site may change as books, formats, tools, providers, or publishing activities change.
2. Educational Boundaries and No Professional Relationship
The Site and Products may discuss trauma, somatic therapy, consciousness, mental health, relationships, stress, safety, and body-based practices. This content is not medical advice, psychotherapy, diagnosis, treatment, legal advice, crisis care, or emergency service. It is not a substitute for individualized care or advice from an appropriately qualified physician, licensed mental-health professional, trauma-informed clinician, attorney, legal advocate, or other professional.
Using the Site, using the Breath tool or Field Guide companion app, purchasing or reading a Product, or emailing The Soma Script does not create a clinician-client, therapist-client, doctor-patient, attorney-client, fiduciary, or other professional relationship.
Do not use the Site or a Product to diagnose, treat, cure, prevent, or manage a medical or mental-health condition. Decisions involving health, treatment, medication, personal safety, or law should be made with appropriately qualified professionals.
3. Safety and Urgent Support
Some Site content and book excerpts describe violence, trauma, dissociation, suicidal despair, relational harm, and body-based practices. Read and participate at a scale you can carry. The Reader Safety page provides additional guidance on stopping, orienting, returning, and finding appropriate support.
The Site, its tools, and the Company email inbox are not emergency communication channels and are not continuously monitored. Sending a message or entering information into a local tool does not create a duty to monitor, intervene, or provide urgent assistance.
If you are in immediate danger, may harm yourself or someone else, or need urgent medical or mental-health support, contact local emergency services. In the United States and its territories, call or text 988 or use the 988 chat service. Outside the United States, use the emergency and crisis services available where you are.
Nothing on the Site asks anyone to remain in danger. When a relationship, environment, or situation is unsafe, distance, outside support, legal protection, medical care, or emergency help may be the necessary action.
4. Breath Tool and Body-Based Practices
The Breath page offers optional breathing, pacing, sound, orienting, and awareness exercises for general educational and reflective use. Products may also describe body-based practices, including structured breathing, interoception, movement, and optional cold exposure. These materials are not medical devices, diagnostic tools, treatment programs, or substitutes for individualized care.
Participation is voluntary. Results vary, and no particular physical, emotional, therapeutic, or consciousness-related result is promised. Stop immediately if a practice produces chest pain, severe or unusual shortness of breath, faintness, loss of consciousness, confusion, pain, panic, blankness, dissociation, numbness, loss of orientation, or difficulty returning to the present. Seek urgent care when symptoms are severe or concerning.
Use practices only in a stable, physically safe setting. Do not use the Breath tool or perform attention-altering practices while driving, operating machinery, in water, or anywhere a change in breathing, attention, balance, or awareness could create a risk of injury.
Some practices may be unsuitable for people with cardiovascular, respiratory, neurological, or other medical conditions; for people who are pregnant; for people taking medications that affect heart rate, blood pressure, breathing, balance, or alertness; or for people experiencing active panic, dissociation, trauma symptoms, or an unsafe environment. Seek qualified guidance before using a practice that may be medically or psychologically risky for you.
The Breath tool may function differently across browsers, devices, accessibility settings, and operating systems. You remain responsible for choosing whether, when, and how to use it.
5. Field Guide Companion App and Local Records
The Field Guide companion app is a self-reflection and pattern-tracking tool. It is not a medical device, diagnostic instrument, psychotherapy service, clinical record system, crisis service, or secure health-information system. It does not evaluate risk, interpret entries, contact emergency services, or provide professional recommendations.
Field Guide entries, patterns, dates, preferences, and unfinished traces are designed to remain locally on your device. The Soma Script does not receive, review, monitor, moderate, or create a cloud backup of those local records. You retain your rights in the content you enter locally and grant The Soma Script no license to that content merely by using the app.
Local records may be lost if you clear browser data, reset or replace a device, use private browsing, remove the installed web app, or if a browser or operating system removes stored data. The Soma Script cannot retrieve or restore records that exist only on your device. You are responsible for protecting access to your device and deciding what information is appropriate to enter, especially on a shared or monitored device.
Offline access depends on browser cache, local storage, service-worker support, device settings, and prior loading of the app. Offline availability, persistence, and compatibility are not guaranteed on every device or after every software update.
6. Eligibility and Children
The Site is intended for a general adult audience. If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian. The Site is not directed to children under 13, and children under 13 may not use the Site or its local tools.
A purchaser must have legal capacity to enter into a purchase or must act with the authorization of a parent or legal guardian.
7. Intellectual Property and Site License
The Site and its contents, including text, excerpts, software, source and object code, design, graphics, logos, images, audio, video, interactive elements, downloads, page layouts, and other materials (collectively, "Site Content"), are owned by or licensed to The Soma Script and are protected by copyright, trademark, and other laws.
Subject to these Terms, The Soma Script grants you a limited, revocable, personal, non-exclusive, non-transferable license to access and use the Site and its browser-based tools for lawful, personal, non-commercial purposes. This license does not transfer ownership of Site Content or software.
You may view the Site for personal, non-commercial use, share ordinary links to public pages, and quote brief excerpts for reviews, scholarship, commentary, teaching, or other uses permitted by law, with appropriate attribution. All other uses require prior written permission.
Except as permitted by applicable law, you may not copy, reproduce, publish, distribute, adapt, translate, sell, license, scrape, archive, mirror, upload, transmit, reverse engineer, decompile, disassemble, or otherwise exploit Site Content or software without written permission.
You may not use Site Content or purchased digital Products to create training datasets or to train, fine-tune, test, evaluate, or improve artificial-intelligence, machine-learning, generative-content, or automated-content systems without prior written permission from The Soma Script.
Edge to Path, The Soma Script, Max Theodor, and related names, titles, phrases, logos, or branding may be trademarks, service marks, trade names, or protected brand identifiers. You may not use them in a way that suggests endorsement, affiliation, or sponsorship without written permission.
8. Permitted and Prohibited Use
You agree to use the Site only for lawful purposes and in a way that does not interfere with the Site, its security, its providers, or the rights of others.
- use the Site for unlawful, harmful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, invasive, or otherwise unlawful activity;
- attempt to gain unauthorized access to the Site, servers, systems, networks, files, local records belonging to another person, or provider accounts;
- introduce malware, viruses, harmful code, or tools designed to impair, probe, disrupt, or overload the Site;
- use bots, crawlers, scraping tools, automated extraction, or bulk-download systems without written permission;
- circumvent access controls, download restrictions, watermarking, license limits, or other protective measures;
- misrepresent your identity, impersonate another person, or submit false or misleading information;
- submit or expose private or identifying information about another person without authority or consent;
- republish, resell, sublicense, or create substitute or derivative commercial products from Site Content or purchased Products without permission; or
- interfere with normal Site operation, security, hosting, email transmission, payment processing, or digital delivery.
9. Communications and User Submissions
If you send an email, question, suggestion, review, testimonial, attachment, or other communication to The Soma Script (collectively, "Communications"), you are responsible for what you send and for having the right to send it.
Ordinary email is not a secure clinical, medical, legal, or emergency channel. Please leave out medical records, therapy records, crisis details, private trauma histories, confidential client information, financial credentials, and sensitive identifying information about other people.
You retain ownership of your Communications. You grant The Soma Script a limited, non-exclusive permission to receive, copy, store, and process them only as reasonably necessary to respond, fulfill a request, maintain appropriate business records, comply with law, or protect legal rights.
Private emails, personal stories, and identifiable Communications will not be quoted, published, used as testimonials, or used in marketing without separate, explicit permission. Public reviews or social-media posts remain subject to the settings and terms of the platform where they appear.
General feedback about Site operation may be considered without compensation or confidentiality obligations. We will not publicly identify or quote you in connection with that feedback without permission.
You represent that your Communication does not violate these Terms, applicable law, confidentiality obligations, or another person's intellectual-property, privacy, publicity, or other rights.
10. Purchases and Outside Checkout Providers
The Site may link to outside checkout, payment, retailer, and fulfillment providers for books, ebooks, audiobooks, companion materials, or other products identified at the point of purchase (collectively, "Products"). The Site does not process full payment-card information directly.
Current providers may include Gumroad, Payhip, Stripe, PayPal, BookFunnel, and other retailers or services identified at checkout or delivery. The provider's role, terms, privacy policy, refund procedures, tax treatment, and customer-service process apply to the part of the transaction or service that it controls.
Gumroad may act as merchant of record for transactions it processes. Payhip may provide a hosted checkout and distribute digital content, with payment routed through supported payment gateways. The exact seller, licensor, merchant-of-record, and payment-processing roles are the roles shown at checkout and in the applicable provider terms.
By completing a purchase, you agree to pay the price and applicable taxes shown at checkout and to provide accurate billing, contact, and delivery information. An outside provider or The Soma Script may decline or cancel an order because of payment failure, suspected fraud, pricing error, legal restriction, product unavailability, or another legitimate reason. If payment has been captured for a canceled order, the responsible provider will process the legally required or otherwise approved refund.
11. Digital Product License
After a completed purchase, and subject to these Terms and any product-specific terms, The Soma Script grants you a limited, personal, non-exclusive, non-transferable license to access and use the purchased digital Product for your own non-commercial reading, listening, or reference. A purchase transfers a license to use the digital Product; it does not transfer ownership of the copyright or other intellectual-property rights.
Where the delivery provider permits, you may download the Product to your personal devices and keep a reasonable personal backup. You may not:
- share, forward, publish, upload, post, or distribute the Product or its private delivery link;
- resell, rent, sublicense, gift by file transfer, or make the Product available through a shared library, torrent, cloud folder, public repository, or other unauthorized sharing system;
- remove copyright notices, watermarking, identifying information, or technical access controls;
- convert or reproduce the Product for commercial use, public distribution, institutional distribution, or a derivative product;
- use the Product for artificial-intelligence or machine-learning training, evaluation, or dataset creation without written permission; or
- permit another person to use your purchase credentials or private delivery link in a way that exceeds ordinary personal use.
Book clubs, classrooms, libraries, organizations, clinics, and other institutions should request permission or obtain an appropriate license unless their use is already permitted by law. Statutory rights, including fair use and other applicable exceptions, remain unaffected.
Free excerpts and downloadable materials are also limited to personal, non-commercial use unless a different license is stated with the material.
12. Digital Delivery, Access, and Preorders
Digital delivery may be provided by BookFunnel or another provider identified at purchase. A delivery provider may send a unique private link, provide a cloud reader or application, apply download or access limits, and provide technical assistance for downloading or transferring an ebook or audiobook.
You are responsible for entering an accurate email address, checking spam or filtered folders, and using a reasonably compatible device or application. Product pages or delivery providers may identify supported formats, device requirements, download periods, or access conditions.
If a delivery message does not arrive or a file cannot be accessed, contact the delivery provider or email The Soma Script with the order number and purchase email. We will make reasonable efforts to help route the issue to the appropriate provider, but provider outages, account restrictions, device incompatibility, and third-party delays may remain outside our control.
A preorder will be delivered on or near the release date displayed at purchase, subject to provider processing and any later notice. Release dates may change. If a preorder is canceled or materially delayed, refunds and other remedies will be handled under the checkout provider's terms and applicable law.
13. Refunds, Prices, Taxes, and Payment Disputes
Prices, currencies, taxes, discounts, availability, and promotions are shown at checkout and may change before an order is completed. The checkout provider, merchant of record, payment processor, or retailer may handle payment processing, taxes, refunds, and chargebacks for the transaction it controls.
Except where a refund or cancellation right is required by law or provided by the applicable checkout provider, direct sales of digital books, audiobooks, downloads, and other digital Products are final once access or delivery has been provided.
The Soma Script does not ordinarily provide refunds after access or delivery because a customer finished reading or listening to the Product, changed their mind, disagreed with the content, expected a different kind of book, failed to use the Product, or requested a refund without a delivery, access, billing, or material technical issue.
The Soma Script may approve a refund for a duplicate charge, failed delivery, or a material technical problem that prevents access and cannot be resolved after reasonable troubleshooting, or when required by law. An outside checkout provider, retailer, merchant of record, or payment processor may separately approve, deny, or process a refund under its own terms and legal obligations.
Where applicable law provides a withdrawal or cooling-off right, that right remains in effect unless and until it is lawfully lost. For digital content supplied immediately, checkout may ask you to expressly consent to immediate supply and acknowledge that starting the download, stream, or access ends the withdrawal right where the law requires that consent and acknowledgement.
To request help with a duplicate charge, failed delivery, or unresolved technical access issue, contact us promptly and include the order number, purchase email, and a brief description of the issue. Contacting us or the responsible provider before initiating a payment dispute gives the parties an opportunity to investigate and resolve the problem. Nothing in these Terms prevents a lawful chargeback, refund request, warranty claim, or other consumer remedy that cannot legally be waived.
Physical books or other physical goods purchased through an outside retailer are subject to that retailer's shipping, return, replacement, and refund terms, together with applicable law.
14. Newsletters and Email Updates
The Site does not currently operate an email newsletter signup. If a mailing list or launch-update signup is added later, the signup page will explain what messages will be sent and how to unsubscribe. Marketing email will include an unsubscribe method where required by law.
A purchase or direct inquiry may still generate transactional, delivery, administrative, security, or legal messages connected to that transaction or request. Outside providers may send messages under their own terms and the choices available on their platforms.
15. Third-Party Links and Services
The Site may link to outside websites, checkout providers, retailers, payment services, delivery services, crisis resources, or informational resources. Current examples may include Gumroad, Payhip, Stripe, PayPal, BookFunnel, Netlify, and book retailers identified at the point of use.
Once you leave the Site or open an outside service, that service's terms and privacy practices apply. The Soma Script does not control and is not responsible for an outside service's content, security, availability, accessibility, accuracy, pricing, policies, or handling of personal information. A link does not necessarily imply endorsement.
16. Testimonials, Reviews, and Results
Any testimonial, reader response, review, or example used by The Soma Script will be based on an actual communication and used with permission. It may be shortened or lightly edited for length, grammar, or privacy without changing its meaning. A material relationship or incentive will be disclosed where required by law.
Individual experiences vary. No book, excerpt, Breath practice, Field Guide tool, essay, educational resource, or other Product guarantees healing, symptom relief, trauma recovery, personal transformation, clinical improvement, spiritual development, business results, or any other outcome.
17. Copyright Complaints
If you believe material on the Site infringes your copyright, email The Soma Script with enough information to identify the copyrighted work, locate the challenged material, explain the basis of the claim, and allow us to respond. This section does not waive any rights or defenses available under law.
18. Privacy
Use of the Site is also governed by the Privacy Policy. The Privacy Policy explains the local-only operation of the Breath tool and Field Guide companion app, the limited information handled directly by The Soma Script, and the role of outside providers.
Outside checkout, payment, retailer, hosting, and delivery providers process information under their own privacy policies. Review those policies before submitting payment, delivery, account, or other personal information.
19. Site and App Availability, Corrections, and Changes
We may update, correct, remove, suspend, or discontinue any part of the Site, Site Content, Breath tool, Field Guide companion app, offline functionality, or a Product offering. We may correct typographical errors, inaccurate descriptions, broken links, pricing errors, or other mistakes at any time.
We do not guarantee that every page, tool, local record, offline cache, file, format, or provider link will remain available or function without interruption. Maintenance, browser changes, storage policies, operating-system changes, hosting issues, security events, provider outages, or other circumstances may affect access or local data.
20. Disclaimer of Warranties
To the fullest extent permitted by law, the Site, Site Content, Breath tool, Field Guide companion app, local-storage and offline functions, free materials, and Products are provided "as is" and "as available." The Soma Script disclaims express and implied warranties, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, data persistence, compatibility, and uninterrupted or error-free operation.
We do not promise that the Site or an outside service will be secure, uninterrupted, current, free of errors, free of harmful components, compatible with every device, able to preserve local records, or available at all times. Educational and research-related information may become outdated as evidence, standards, services, and laws change.
Some jurisdictions provide warranties or consumer rights that cannot be disclaimed. Those rights remain in effect.
21. Limitation of Liability
To the fullest extent permitted by law, The Soma Script and its owners, members, managers, employees, contractors, representatives, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages; lost profits, data, local records, goodwill, or business opportunity; emotional distress; or other losses arising from or related to the Site, Site Content, Breath tool, Field Guide companion app, Products, outside providers, or inability to access them.
To the fullest extent permitted by law, the total liability of The Soma Script for any claim arising from or related to the Site, a Product, or these Terms will not exceed the greater of the amount paid for the specific Product or service giving rise to the claim or one hundred U.S. dollars (US $100).
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence where it cannot be limited, death or personal injury where applicable law prohibits limitation, or any other liability or consumer right that cannot legally be excluded or limited.
Some jurisdictions do not allow certain exclusions or limitations, so some of this section may not apply to you.
22. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless The Soma Script and its owners, members, managers, employees, contractors, representatives, licensors, and service providers from third-party claims, liabilities, damages, losses, costs, and reasonable legal fees arising from your unlawful use of the Site, your material breach of these Terms, your violation of another person's rights, or content you submit without the necessary rights or consent.
This section does not require you to indemnify a party for that party's own fraud, willful misconduct, or liability that cannot legally be shifted to you.
23. Suspension and Termination
We may restrict or terminate access to the Site or a Site feature when we reasonably believe a user has violated these Terms, threatened security, infringed rights, engaged in fraud, shared purchased files or access links without authorization, or interfered with Site or provider operation.
An outside provider may separately suspend payment, account, download, or delivery access under its own terms. Suspension does not remove payment obligations, intellectual-property restrictions, or provisions that by their nature should continue after termination.
24. Governing Law, Venue, and Consumer Rights
These Terms are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict-of-law rules.
To the extent permitted by law, a dispute arising from these Terms or the Site will be brought in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts.
If you are a consumer, nothing in these Terms deprives you of protections, remedies, withdrawal rights, warranties, or access to courts that cannot be waived under the law where you live. Mandatory consumer law controls where it applies.
25. Changes to These Terms
We may update these Terms to reflect changes in the Site, Products, tools, providers, business practices, or law. The revised version will appear on the Site with a new "Last updated" date.
Unless a change is required by law, security, or provider operation, a completed purchase is generally governed by the product and license terms in effect when the purchase was made. Continued use of the Site after revised Terms take effect means you accept the revised Terms for later Site use.
26. Severability, Entire Agreement, Priority, and No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted as closely as possible to its lawful purpose.
These Terms, the Privacy Policy, the Reader Safety page, and any product-specific Company terms displayed at purchase form the agreement between you and The Soma Script concerning the Site and Products. Outside-provider terms form separate agreements between you and those providers.
If terms conflict, mandatory law controls first; product-specific Company terms control the Product; outside-provider terms control the outside provider's service or transaction; and these Terms control the Site and licenses granted directly by The Soma Script.
A failure to enforce a provision is not a waiver of that provision or any other right. You may not assign your rights under these Terms without written permission. The Soma Script may assign these Terms as part of a merger, reorganization, financing, sale of assets, or similar business transaction.
